35 USC 102(a)(1) review
35 USC 102 section (a), subsection 1
- This law outlines the reasons for why a claimed invention might be denied patent protection based on novelty (meaning, the proposed patent has already been patented or published, etc).
- There ARE however, exceptions to that law, and those exceptions and circumstances are found: 35 USC 102 section (b), subsection 1
- Another way to think of it is this way: There are things that would fall in line with 35 USC 102(a)(1), however, under 35 USC 102 (b)(1), would not be able to be used to prevent the patent from being filed/issued.
